1. Introduction, Acceptance, and Definitions

1.1. Acceptance of Terms

Welcome to Flights Search Tool (the "Service"), owned and operated by GoPassFlights ("we," "us," or "our"). The Service is a specialized utility providing flight availability data for holders of the Frontier Airlines GoWild! Pass. By accessing or using the Service, you confirm that you have read, understood, and irrevocably agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

Your continued use of the service, whether as a paid subscriber or free user, constitutes immediate and unconditional acceptance of these terms. If you do not agree, you must immediately cease all access to and use of the service.

1.2. Independent Status and No Affiliation

GoPassFlights is an independent technology provider and is NOT affiliated with, authorized by, endorsed by, or sponsored by Frontier Airlines. We do not act as an agent or representative of Frontier Airlines. All travel, booking, and pass-related issues are exclusively handled by Frontier Airlines.

2. Financial Terms and Recurring Billing

2.1. Monthly Recurring Subscription

The Service is offered via a mandatory monthly subscription. By purchasing a subscription, you explicitly authorize us (or our third-party payment processor) to charge your designated payment method the recurring monthly fee, plus applicable taxes, until actively canceled. Your subscription will automatically renew at the end of each monthly period.

2.2. Non-Refundable Fees and Price Adjustments

All subscription fees and charges are non-refundable. No refunds, partial or full, will be issued for unused time or cancellation. We reserve the right to change our fees at any time; notice will be provided at least thirty (30) days prior to the new fee taking effect. Your continued use of the Service after the notice constitutes agreement to the new price.

3. Data Accuracy, Use, and Intellectual Property

3.1. Critical Data Disclaimer

The flight data displayed is constantly changing, and derived from publicly available sources at the time of query. We provide no warranty, express or implied, as to the accuracy, completeness, or timeliness of the flight information displayed. You acknowledge that the final and confirmed status of any flight, including pricing and Pass eligibility, is determined solely by Frontier Airlines at the time of booking.

3.2. Prohibited Data Scraping

You agree to use the Service solely for personal, non-commercial use. You are expressly and strictly prohibited from utilizing the Service to engage in or facilitate any unauthorized data scraping, automated data harvesting, or bulk data extraction, either from the Service itself or from Frontier Airlines' platforms. Any such activity constitutes a material breach of these Terms. You agree NOT to use the Service for any purpose that is unlawful or prohibited by these terms. This includes, but is not limited to:

• Using any automated system (robots, spiders, or scrapers) to access, monitor, or copy any part of the website or its data, other than for bona fide public search engine indexing.

• Reselling, redistributing, or exploiting any data, content, or search results from the Service for commercial gain.

• Attempting to interfere with the proper working of the Service, including by launching denial-of-service attacks.

• Violating the rules or policies of Frontier Airlines, or any third-party service provider.

3.3. Trademark Disclaimer

Any use of trademarks owned by Frontier Airlines (e.g., "GoWild!") is made under the doctrine of Nominative Fair Use solely to identify the subject matter of the search and does not imply endorsement or affiliation.

4. Indemnification and Limitation of Liability

4.1. User Indemnification

You agree to fully indemnify, defend, and hold harmless GoPassFlights, its officers, directors, and agents, from and against any and all liabilities, damages, and expenses (including attorney’s fees) arising from: (a) any claim or legal action brought against us by Frontier Airlines or any third party as a direct or indirect result of your use of this Service or the data obtained from it; (b) your breach of these Terms; or (c) any negligent or wrongful act by you related to the Service.

4.2. Limitation of Our Liability

To the maximum extent permitted by law, GoPassFlights shall not be liable for any indirect, incidental, punitive, or consequential damages, or any loss of profits, data, or revenue, arising from your use of the Service or reliance on its data. Your sole remedy for dissatisfaction is to cease use of the Service and cancel your subscription. Our total aggregate liability will not exceed the amount you paid for the Service in the preceding twelve (12) months.

5. Termination and Changes to Terms

5.1. Termination of Access

We reserve the right to immediately terminate or suspend your access to the Service, without prior notice or refund, for any reason whatsoever, including, without limitation, a breach of these Terms or if we receive notice from Frontier Airlines regarding unauthorized use.

5.2. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Service. Your continued use of the Service after such notification constitutes your acceptance of the updated Terms.

6. General Provisions and Contact Information

6.1. Entire Agreement and Severability

These Terms constitute the entire agreement between you and GoPassFlights concerning the use of the Service. If any provision is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
